1. Yes, because "there" is here. Events in the past leave traces that last into the present, and we can and do look at that evidence today.
It's not the same as being right "there" to observe such an event as operational science is based on. Sure, the past leaves traces but there are two interpretations of that evidence. It's all a matter of what one considers as the best theory.
2. If this response were a valid challenge to evolution, it would equally invalidate creationism and Christianity, since they are based on events that nobody alive today has witnessed.
Talk Origins once again misinterprets the meaning of what creationists are portraying. It's a response to the fact that many claim macro-evolution is fact and it presents that they cannot say this with full assurance. That's true, but God was there to witness that creation and revealed it to us through His Word.
3. A more useful and more general question is, "How do you know?"
You can't "know" that evolution occurred without being there! This is why the question is asked.
