The page where I got the picture (http://www.oehha.ca.gov/public_info/pdf/Red%20Phosphorus%20Fact%20Sheet%20Meth%20Labs%2010%2703%27.pdf), gives the photo credit to the CA Department of Justice, which is a state entity.

Just to make sure, the department (http://oag.ca.gov/conditions) lists under "Ownership" that its content is "[c]onsidered in the public domain. It may be distributed or copied as permitted by law". The site goes on to say that it does make use of copyrighted material, but as the photo was marked "Courtesy of CA Department of Justice" on the page I got the photo from, and not courtesy of the photographer, the photo must be property of the California Department of Justice.
